FKCCI Updates | Regulation – Korea Sets a Global First in AI Regulation

Korea has taken a major step in the global governance of artificial intelligence with the enactment of the Framework Act on Artificial Intelligence, becoming the first country worldwide to establish a comprehensive legal framework regulating the use of AI.

This landmark legislation aims to strike a careful balance between supporting innovation and building trust. By encouraging AI development while ensuring safe, ethical, and responsible use, the law seeks to protect users, businesses, and society as a whole.

From a governance perspective, the Act introduces a national AI governance framework, alongside clear rules for high-impact and generative AI systems. Importantly for companies, it also provides for a transition period of at least one year, during which no inspections or sanctions will be imposed. This approach is designed to give stakeholders sufficient time to adapt to the new regulatory environment.

According to the Korean authorities, the objective is clear: reduce legal uncertainty while fostering the emergence of a safe, healthy, and trusted national AI ecosystem. For companies operating in or entering the Korean market, this new framework offers greater regulatory clarity at a time when AI technologies are rapidly transforming industries.
